1. Acceptance of Terms
These Terms of Service (the "Terms") govern your access to and use of the Mill Standard website, online storefront, and design tools (together, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account or place an order. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.
3. Accounts
- You are responsible for keeping your account credentials confidential and for all activity that occurs under your account.
- You agree to provide accurate, current information and to keep it up to date.
- Notify us promptly at info@millstandard.com if you suspect unauthorized use of your account.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Attempt to gain unauthorized access to any part of the Service or to other users' accounts.
- Interfere with, disrupt, or place an unreasonable load on the Service or its infrastructure.
- Reverse-engineer, scrape, or copy substantial portions of the Service except as expressly permitted by law.
- Submit content that is infringing, defamatory, obscene, or otherwise unlawful.
5. Orders, Pricing, and Payment
- Prices and product availability are subject to change without notice. We may correct pricing or descriptive errors and reserve the right to cancel orders placed with incorrect information.
- Payment is processed by Stripe. By placing an order, you authorize Mill Standard (through Stripe) to charge your selected payment method for the order total, including taxes and shipping.
- Title and risk of loss pass to you upon delivery to the carrier, unless otherwise stated at checkout.
6. Shipping, Returns, and Refunds
Shipping
Shipping options, costs, and estimated delivery times are shown at checkout. In accordance with the Federal Trade Commission's Mail, Internet, or Telephone Order Merchandise Rule (16 C.F.R. Part 435), we will ship your order within 30 days of receiving your payment, or we will notify you of any delay and give you the option to consent to the delay or cancel your order for a full refund. Title and risk of loss pass to you upon delivery to the carrier.
Damaged in transit. If your shipment arrives damaged, please contact us within 7 calendar days of delivery with photos of the damage and packaging so we can file a carrier claim and arrange a replacement or refund.
Returns
You may return most items in new, unused condition within 30 days of delivery, subject to the following conditions:
- Items must be in their original packaging with all included hardware, fasteners, instructions, and accessories.
- Items must show no signs of installation, assembly, modification, or use.
- You must include the original packing slip or order number.
- You are responsible for return shipping costs unless the return is due to our error or a defective product.
The following items are non-returnable:
- Custom, made-to-order, or made-to-measure items (including custom finishes and special-order configurations).
- Items marked "Final Sale" or "Clearance" at the time of purchase.
- Items that have been installed, assembled, modified, or damaged after delivery.
How to start a return
Email info@millstandard.com with your order number and the items you wish to return. We will issue a Return Merchandise Authorization (RMA) and shipping instructions. Returns sent without an RMA may be refused or delayed.
Refunds
Once we receive and inspect your return, we will process your refund to the original payment method within 7 business days. Depending on your bank or card issuer, the refund may take an additional 3–10 business days to appear on your statement. Refunds include the purchase price of the returned items and any sales tax paid on those items. Original shipping charges are non-refundable except where the return is due to our error or a defective product.
Defective or incorrect items
If you receive a defective or incorrect item, contact us within 7 calendar days of delivery. We will arrange a free return and, at your option, ship a replacement or issue a full refund including original and return shipping.
Order cancellations
You may cancel an order at no charge any time before it has shipped. Once an order has shipped, the return policy above applies. Custom or made-to-order items can only be cancelled before production begins — please contact us as soon as possible.
Manufacturer warranties
Many of our products are covered by manufacturer warranties. Where applicable, warranty terms are provided with the product or on the product page. Nothing in this policy limits any rights you may have under applicable law, including the Magnuson–Moss Warranty Act (15 U.S.C. § 2301 et seq.) or under any express manufacturer warranty. Some states do not allow limitations on implied warranties, so the limitations in this section may not apply to you.
Chargebacks
If you have a problem with an order, please contact us first — most issues can be resolved quickly. Initiating a chargeback before contacting us may delay resolution and, in cases of bad-faith chargebacks, may result in suspension of your account.
7. Design Tools and AI-Generated Output
The Service includes design tools that use artificial-intelligence systems (including the AI Kitchen Builder and sketch-to-3D rendering) to produce suggestions, layouts, quotes, and visualizations based on inputs you provide.
- AI-generated output is provided for inspiration and planning purposes. It may contain errors, omissions, or inaccuracies, and is not a substitute for professional design, engineering, or installation advice.
- Quotes, dimensions, and product fit shown in renders or layouts are estimates. Final pricing, dimensions, and product availability are confirmed at the order stage.
- Inputs you submit may be transmitted to third-party AI processors (e.g. OpenAI, Google Gemini, Tripo3D) to generate output, as described in our Privacy Policy.
8. User Content and License
When you upload sketches, photos, project details, reviews, or other materials ("User Content"), you keep ownership of your User Content. You grant Mill Standard a non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify, and display your User Content solely as necessary to operate and improve the Service (including generating renders, quotes, and order records).
You represent and warrant that you have the rights necessary to grant this license and that your User Content does not infringe the rights of any third party.
9. DMCA / Copyright Complaints
We respect intellectual-property rights and respond to clear notices of alleged copyright infringement under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. If you believe content available through the Service infringes your copyright, send a written notice to our designated agent that includes:
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material claimed to be infringing and information reasonably sufficient to allow us to locate it (e.g., a URL).
- Your contact information (name, address, telephone number, email).
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf.
- Your physical or electronic signature.

Counter-notification. If you believe your content was removed in error, you may submit a counter-notification meeting the requirements of 17 U.S.C. § 512(g)(3).
Repeat infringers. We may terminate the accounts of users who are determined to be repeat infringers.
10. Intellectual Property
The Service, including the Mill Standard name, logo, product photography, written content, software, and design, is owned by Mill Standard or its licensors and is protected by intellectual-property laws. Except as expressly permitted by these Terms, no part of the Service may be copied, modified, or distributed without our prior written consent.
11. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Mill Standard does not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.
12. Limitation of Liability
To the maximum extent permitted by law, Mill Standard and its officers, directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service.
Mill Standard's total liability arising out of or related to these Terms or your use of the Service will not exceed the greater of (a) the amount you paid us in the twelve months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the limitations in this section may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.
13. Indemnification
You agree to defend, indemnify, and hold harmless Mill Standard from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your User Content, or your violation of these Terms.
14. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to the Service or other users. You may close your account at any time by contacting us. Sections that by their nature should survive termination (e.g. ownership, disclaimers, limitation of liability, indemnification, governing law, and the General Provisions) will survive.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Any dispute arising out of or related to these Terms or the Service will be resolved exclusively in the state and federal courts located in the State of Delaware, and you consent to the personal jurisdiction of those courts.
16. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
17. General Provisions
Entire Agreement. These Terms and our Privacy Policy together form the entire agreement between you and Mill Standard regarding the Service and supersede any prior agreements on the same subject.
Severability. If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect.
No Waiver. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
Assignment. You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law.
Force Majeure. We will not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, governmental action, internet or telecommunications outages, or supplier failures.
Electronic Communications. By using the Service, you consent to receive communications from us electronically (e.g., by email or via the Service). You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.
Notices. We may provide notices to you by email at the address associated with your account or by posting on the Service. You may send notices to us at info@millstandard.com or by mail to the address in Section 18.
